Uninsured and Underinsured Coverage Address Different Problems

Uninsured motorist coverage concerns qualifying losses involving an uninsured driver. Underinsured motorist coverage concerns an insured driver whose available coverage may be insufficient. The particular policy and governing law control whether a benefit is available.

Bring the complete policy and endorsements, not only a premium bill. We review who is insured, the vehicle and household involved, the limits selected, and notices or exclusions raised by the insurer. The Rhode Island insurance consumer guidance provides a general coverage starting point.

Notify Counsel Before Settling with Another Insurer

A liability settlement or release can raise questions under a separate UM or UIM policy. Before signing, identify all policies being reviewed and discuss any notice, consent, or reimbursement issue that may affect the next step. Do not assume payment from one insurer closes the entire claim.

Keep a record of who has been notified, when the notice was sent, and what each insurer has requested. Coverage disputes and injury valuation may need to be addressed separately.

  • Full auto policies, declarations pages, endorsements, and any coverage selection or rejection documents.
  • Crash report information, driver and insurer details, and correspondence about available limits.
  • Medical and work-loss records, benefit-payment notices, and denial or reservation-of-rights letters.
  • Proposed settlements, releases, and the dates of any upcoming response deadlines.

Can Household or Other Coverage Matter?

It may. Identify the policies held by you and your household and describe your role in the collision.
