Section 12-19-14 addresses probation proceedings involving a new criminal charge and technical violations that do not constitute a new criminal offense. The court needs the alleged conduct and the actual conditions of probation, rather than simply the label on a notice.
A new criminal case and the probation proceeding can require coordinated preparation. Bring papers for both and tell counsel about every upcoming date.
The statute provides for a hearing within 30 days of arrest unless waived by the defendant, with an opportunity to be present and respond. It sets a fair-preponderance-of-the-evidence standard for determining a violation.
If a violation is found, the court has several sentencing and probation options under the statute, including continuing a suspension or ordering imprisonment on a previously imposed sentence or a lesser sentence. The available response depends on the judgment and circumstances; an allegation alone does not tell you the outcome.
