A Rhode Island deferred-sentence agreement should be kept with the plea papers, docket and every condition the court imposed. Start with the written agreement and its date. An informal description of the disposition is not a substitute for that record.
The practical questions are what the agreement requires, what compliance records exist and what court action remains. This guide concerns the Superior Court provision in §12-19-19.
Locate the written deferral agreement
Section 12-19-19 addresses formal deferral after a guilty or nolo contendere plea in Superior Court and requires a written agreement between the person and the court, filed with the clerk. R.I. Gen. Laws § 12-19-19 (2026)
Keep the signed agreement, plea papers and any later amendment. Record the court, docket number and agreement date. Identify missing pages or inconsistent copies for counsel. Do not assume a disposition called “deferred” in conversation matches every document in the file.
Track the terms and the evidence of compliance
The statute addresses conditions of the written agreement and allows a sanction or sentence for a violation determined through the referenced probation-violation procedures. R.I. Gen. Laws § 12-19-19 (2026) R.I. Gen. Laws § 12-19-19 (2026)
Make a list of the conditions actually stated. Keep receipts, program records, reporting documents and written communications about an obstacle. Preserve any court modification alongside the earlier order so counsel can see which version applied at the relevant time.
If a notice alleges a violation, keep the original notice and its delivery information. Identify the precise condition, the claimed event and the upcoming appearance. A chronology should distinguish the date of the alleged conduct from the date of the notice.
Successful completion and expungement are separate steps
After the deferment period, a court determination following a hearing that all agreement conditions were satisfied makes the person immediately eligible for consideration for expungement under the referenced provisions. That is not automatic expungement. R.I. Gen. Laws § 12-19-19 (2026)
Keep the completion decision and resulting docket entries. Identify any remaining payment issue from the actual court records. Before describing the disposition to an employer or licensing authority, obtain advice about the question being asked and the record that exists.
Review timing using the complete file
The statute contains a limit on imposing sentence after the written agreement and a violation exception. Application to a particular chronology requires review of the agreement, violation record and governing procedure. R.I. Gen. Laws § 12-19-19 (2026)
List each important date and the document establishing it. Do not guess whether a later paper was timely from the agreement date alone. Identify other pending cases separately so their records do not become mixed with this disposition.
Arrange a Rhode Island review
Bring the agreement, plea and sentencing papers, notices, compliance records and current docket. Tell counsel if a court date is close. The criminal defense guide provides broader preparation, and the Providence office accepts consultation requests.
